The Glenlee $0 Builder Deposit Promotion (Promotion) is subject to the following terms and conditions:
Terms and Conditions
By completing and submitting the Registration Form supplied the Promoter, the registrant accepts these Terms and Conditions of entry.
The development is the development known as Glenlee at 274-280 Reserve Road, Charlemont 3217] (Development) developed by ID Reserve Road Pty Ltd ABN 97 613 209 939 of Level 12, 484 St Kilda Road, Melbourne VIC 3004 (Promoter).
Who is eligible for the Promotion?
The Promotion is available to all persons who: (1) are over the age of 18 years; (2) who have complied with the Offer Process during the Promotion Period (Eligible Purchaser) (3) purchases in stage 3 only of the Glenlee Estate (lots 337-341). Employees of the Promoter are not eligible to apply. Any Eligible Purchaser who, in the opinion of the Promoter: (a) does not effect settlement of the Contract of Sale on the due date; (b) does not otherwise comply with the Contract of Sale, will be ineligible for the Promotion. The Promotion may only be claimed once per Contract of Sale..
Dates of Promotion
The Promotion commences on July 2019 and continues until withdrawn by the Promoter (Promotion Period). The Promoter reserves the right to withdraw the Promotion at any time. Eligible Purchasers up to the time that the Promoter publishes a notice to withdraw the Promotion will remain eligible for the Promotion. Any Contracts of Sale entered into after the Promotion is withdrawn will not be eligible for the Promotion. Notification of the Promotion being withdrawn will be published on the Promoter’s website at https://www.glenleearmstrong.com.au/ (Website).
Subject to these terms and conditions, the Promoter is offering to Eligible Purchasers that the Promoter will pay an amount equal to the 5% deposit payable to the Builder under the Building Contract (Deposit) upon settlement of the Property under the Contract of Sale, where the Eligible Purchaser has, during the Promotion Period:
(a) entered into an unconditional, binding contract of sale between the applicant as the purchaser and the Promoter as the vendor, for the purchase of land (Contract of Sale) at the Development (Property);
(b) entered into an unconditional contract with Shape Homes ACN 619 008 874 (Builder) for the construction of a dwelling on the Property (Building Contract);
(c) pays the deposit for the Property in accordance with the terms of the Contract of Sale;
(d) effects settlement of the Contract of Sale on the due date; and
(e) has complied with all other terms of the Contract of Sale.
Deposits are limited to one per Building Contract for each Property.
Eligibility for the Offer
If the person is an Eligible Purchaser and complies with these terms and conditions, then the Promoter will give written notice of the applicant’s eligibility to receive the Offer. To receive the Deposit, the applicant will be required to verify their eligibility to receive the Deposit. If the Eligible Purchaser does not provide confirmation of their eligibility for the Deposit or if the Contract of Sale does not settle, the Offer is void and the Deposit is not payable. If the Contract of Sale or the Building Contract is terminated, the Deposit amount is not included in any refundable amount.
How will the Deposit be applied?
Upon satisfaction of the Offer Process and verification of eligibility of the Eligible Purchaser, the Promoter will arrange with the Builder for a variation to be issued on the Building Contract noting that the Deposit has been paid by the Promoter to the Builder.
The Eligible Purchaser acknowledges and agrees that all other payments under the Contract of Sale and the Building Contract are the responsibility of the Eligible Purchaser.
Acknowledging and promoting success
The applicant acknowledges and agrees that the Promoter may advertise the Promotion by publishing content including photographs of recipients of the with the Property or the Promoter that may be taken by the Promoter in the Promoter’s marketing material or reports, including social media, the Website, brochures or newspapers.
Promoter’s rights reserved
The Promoter reserves the right to exercise its absolute discretion in excluding applications that it considers to be contrary to law and to substitute the prize for another prize of equal value if the prize is unavailable or unable to be supplied.
All other terms and conditions in the Contract of Sale apply. To the extent of any inconsistency between these terms and conditions and the Contract of Sale, the Contract of Sale will prevail. This Offer cannot be taken in conjunction with any other offer made by the Promoter from time to time without the Promoter’s prior written approval. Prices and availability are subject to change without notice. Purchasers must rely on their own enquiries and the Contract of Sale. The Offer is not an offer of finance. The Promoter takes no responsibility and is not liable for the purchaser’s stamp duty, strata levies or other tax liabilities or government charges. To the extent permitted by law, the Promoter shall not be liable for any loss or damage the Promoter accepts no responsibility for any damage, loss or liabilities that may arise from an eligible applicant receiving an Offer in the Promotion. To the extent permitted by law, the Promoter shall not be liable for any loss or damage whatsoever (including but not limited to direct, indirect, special or consequential loss or damage, loss revenue or profit) or personal injury suffered or sustained in connection with the Promotion or accepting or using the Offer. The Promoter accepts no responsibility for any variation in the value of the Deposit in the Promotion. If, for any reason whatsoever, the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity or proper conduct of the Promotion, the Promoter reserves its right in its sole discretion to take any action that may be available, subject to State and Territory regulations.
The Promotion is governed by the laws of the state of Victoria, Australia.
